Exemption: Content Produced by Third Parties

The owners and operators of the website are not the "producers" of any actual or simulated sexually explicit material presented on it. Regarding such, the operators of bigbooty.tv confine their actions to the transmission, storage, retrieval, hosting and/or formatting of the content, be it depictions of explicit or of simulated sexual activity, that is provided by third-party users of the website. All areas of the website that contain user-supplied content are under the control of the associated user. The operators of bigbooty.tv are therefore excluded from compliance with Section 2257 records keeping and labeling obligations as described in 28 C.F.R. §75.1(c)(4). Any content on the website that, as decided solely by the operator, is judged to be illegal, unlawful, obscene, defamatory, or which in any manner goes against the website's terms of use or other policies may be deleted.

In connection with any content published on the website, for which the website operator is deemed to be the “producer” (primary or secondary) as stated in 18 U.S.C. § 2257 and 28 CFR § 75, such content is excluded from compliance with the requirements of 18 U.S.C. § 2257 and 28 CFR § 75 because, among other things, it does not portray actual sexually explicit behavior.
